ILR Appeals in Immigration Tribunal

 

Update on the AIT Test Case:

 

AIT Test Case concerned with an appeal made by the Home Office against the initial decision of the AIT was listed on 1st May 2008.

 

As informed by the lawyers, the Home Office decided to withdraw their appeal against the initial AIT decision declaring the Indefinite Leave to Remain (ILR) refusal after 4 years was unlawful. So the supposedly test case lasted for few minutes since Home Office withdrew their appeal. We are still waiting for further details from the lawyers on the reasons for the withdrawal.

Earlier we wrote to the Home Office to resolve the ILR issue since the Judicial Review Judgment clearly states that the Government should honour the criteria which was in place when migrants were admitted in the scheme.
